Terms of Service
These terms are the agreement between you, the merchant, and Difae Research, which operates AiBayya. They cover what the service does, what you are responsible for, what we are responsible for, how billing works, and how either side can end it. Using the service means accepting them. They are written to be read once and understood, so the parts that usually surprise people, Meta's separate fees and who answers for what the assistant says, are stated plainly rather than buried.

1. The service
AiBayya connects your online store to your WhatsApp Business number and runs an AI assistant on it. The assistant answers customers, shows products from your own catalog, builds carts, hands over checkout links, recovers abandoned carts, sends order updates, confirms cash-on-delivery orders, and sends broadcasts you compose. Messages are delivered through Meta's official WhatsApp Business Platform, from your number, under your brand.
Features are described on this site and change as the product develops. We may add, change, or remove features. If we remove something you rely on, we will tell you before it happens.
2. Who may use it
The service is for businesses. By accepting these terms you confirm that you are at least 18, that you are authorised to bind the business you are signing up, and that you will use the service for that business rather than as a consumer.
3. What you need, and what stays yours
- A WhatsApp Business Account you control. The number is yours, the WhatsApp Business Account is yours, and it stays yours if you leave. We connect to it with the access you grant, and that access can be revoked by you at any time from Meta's own tools.
- A store we can read. Shopify, WooCommerce, a supported POS, or a catalog you enter with us directly. You are responsible for the accuracy of your prices, stock, and product information. The assistant quotes what your catalog says.
- Your content and your customer data remain yours. We claim no ownership over your catalog, your conversations, or your customer records. We process them to run the service, as described in the Privacy Policy.
4. Your responsibilities when messaging
Messages go out from your number, under your name, so Meta holds you responsible for them, and so do we.
- Comply with Meta's rules. The WhatsApp Business Messaging Policy and Commerce Policy apply to everything sent from your number, including anything the assistant sends. Breaching them can get your number rate limited, your display name revoked, or your WhatsApp Business Account disabled by Meta, and we cannot reverse a Meta enforcement action.
- Only message people who may lawfully be messaged. Marketing and broadcasts require a valid basis for contacting that person. Do not upload purchased or scraped lists. Honour every opt-out: replies of STOP are enforced automatically and must not be worked around.
- Do not sell what may not be sold. Goods and services prohibited by Meta's Commerce Policy or by the law where your customers are must not be sold through the service.
- Keep your credentials safe. Activity under your account is treated as yours. Tell us promptly if you believe an account has been compromised.
5. The AI assistant, stated honestly
The assistant is a language model. It is accurate the overwhelming majority of the time and is constrained to your real catalog and order data, but it is probabilistic, not deterministic, and it can be wrong: it can misread a question, phrase something awkwardly, or answer a policy question you never gave it an answer to.
- You control it. Every capability is a toggle, you can set the assistant's instructions, and you can read every message it sent, word for word, in your dashboard.
- You are responsible for what it sends under your brand, in the same way you are responsible for what an employee sends from your account. Review the conversations, especially in the first days.
- It does not give professional advice. Do not deploy it to give medical, legal, or financial advice, and do not use it to make decisions with legal effect about a person.
6. Fees, and the fee that is not ours
This section exists because it is where WhatsApp tools most often mislead people.
- Our fee is a flat monthly plan, from $29 per month, including a set number of conversations. It is the same on every platform, and there is no commission on your sales. Current tiers and what counts as a conversation are on the pricing page.
- Meta's fee is separate and is not paid to us. Meta charges for certain messages on its own rate card and bills those charges directly to the payment method on your WhatsApp Business Account. We never mark it up, because it never passes through us. What Meta charges for, and what is free, is explained on our WhatsApp pricing page, and Meta changes its rate card from time to time.
- Plans renew monthly until cancelled. Cancel any time, effective at the end of the paid period. Fees already paid are not refunded except where the law requires it.
- Prices can change with at least 30 days' notice before your next renewal. Taxes are your responsibility where they apply.
- Exceeding your plan means being asked to move up a tier, not a surprise overage line on an invoice.
7. Availability
We aim for continuous availability and monitor the service, but we do not offer a contractual uptime guarantee at this stage of the product, and we would rather say so than publish a number we are not committing to. Planned maintenance is announced where it will be noticeable. The service also depends on Meta, your store platform, and our AI provider: an outage at any of them affects it and is outside our control.
8. Suspension and termination
You can stop at any time by cancelling, uninstalling, or disconnecting your number. We may suspend or terminate an account that breaches these terms, puts our Meta or platform standing at risk, is used unlawfully, or has unpaid fees. Except where a breach is serious or a suspension is demanded by Meta or the law, we will warn you first and give you a chance to fix it.
After termination your data is retained until deletion is requested, as explained in the Privacy Policy, and you can ask for it to be deleted at once through the deletion process.
9. Intellectual property
The software, the interface, the brand, and everything we publish belong to Difae Research. You get a non-exclusive, non-transferable right to use the service while your account is active. You may not copy, resell, reverse engineer, or attempt to extract the source of the service, or use it to build a competing product.
10. Warranties and liability
The service is provided as it is. To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose, and uninterrupted or error-free operation.
To the extent the law allows, neither side is liable to the other for indirect or consequential loss, lost profits, lost sales, or lost data, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim arose. Nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.
You will indemnify us against claims arising from your messages, your products, your use of customer data, and your breach of Meta's policies.
11. Changes to these terms
We may update these terms. Material changes are notified to active merchants by email at least 30 days before they take effect, and continuing to use the service after that means accepting them. If you do not accept a change, cancel before it takes effect.
12. Governing law and contact
These terms are governed by the laws of Pakistan, and the courts of Pakistan have jurisdiction over any dispute. We will always try to settle a dispute directly first.
AiBayya is operated by Difae Research, a sole proprietorship registered with the Federal Board of Revenue in Pakistan.
